General Terms and Conditions (GTC) of Diamondz Art

1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by customers through the online shop of Diamondz Art (hereinafter "Seller"). Deviating terms and conditions of the customer are not recognized unless expressly agreed to in writing by the Seller.

3. Offer and conclusion of contract
(1) The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By submitting an order, the customer makes a binding offer to conclude a purchase contract.
(3) The contract is concluded when the seller accepts the order by sending an order or shipping confirmation by email.
(4) The contract language is German.
(5) The contract text is stored by the seller, but is not permanently available online for security reasons.
4. Prices and payment
(1) All prices include statutory VAT.
(2) The available payment methods are indicated in the shop (e.g. PayPal, credit card, SEPA transfer).
(3) The payment amount is due immediately after conclusion of the contract.
(4) The seller reserves the right to exclude individual payment methods.
5. Delivery and shipping
(1) Delivery shall be made to the address specified by the customer.
(2) Shipping costs and delivery times are specified on the shipping page and are displayed in the checkout.
(3) Currently, the seller only delivers to selected European countries (see shipping information).
(4) Delivery deadlines are non-binding unless a specific date has been confirmed in writing.
6. Right of withdrawal
(1) Customers have the statutory right of withdrawal within 30 days for non-custom-made products.
(2) The right of withdrawal is excluded for products that have been individually manufactured at the customer’s request (e.g. special designs on request).
(3) Further details are set out in the separate cancellation policy on the website.
7. Retention of title
The delivered goods remain the property of the seller until full payment has been made.
8. Warranty and Liability
(1) The statutory warranty rights apply.
(2) The seller shall be liable for damages only in cases of intent or gross negligence. In cases of simple negligence, liability shall be limited to breaches of essential contractual obligations.
(3) The seller is not liable for damages resulting from improper use.
9. Copyright and Use
(1) All motifs offered are protected by copyright.
(2) The rights remain with the respective artist or the seller.
(3) The purchase of an image entitles you to use it exclusively for private purposes. Commercial use is prohibited without prior permission.
10. Online Dispute Resolution & Place of Jurisdiction
(1) The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/
(2) The seller does not participate in dispute settlement proceedings before a consumer arbitration board.
(3) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(4) The place of jurisdiction for all disputes is Flensburg.
11. Final provisions
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply instead.
